Thank you for choosing us! These Terms of Service (“Terms”) govern your use of our mobile applications (the “Apps”), websites, and any related products or services we provide (collectively, the “Services”).

Note: The term Services includes the Apps, as well as our websites and any other offerings we may provide now or in the future.

By accessing or using any part of the Services, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree with these Terms, you must not use the Services.

1. Eligibility

You may use the Services only if you:

Can form a legally binding contract with Gallatin Applications LLC and are not prohibited under any applicable laws from doing so.
Meet the minimum age requirements.
Agree to comply with these Terms and all applicable third-party terms.

Age Requirements: You must be at least 13 years old to use our Services. If you are between 13 and the age of majority in your jurisdiction, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Parents and guardians are responsible for their child’s activities and any use of the Services.

2. Grant of Limited License

Subject to these Terms, Gallatin Applications LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Apps and Services solely for personal, non-commercial purposes.

You may not:

Sell, lease, rent, sublicense, or otherwise transfer any rights in the Services to any third party.
Reverse engineer, decompile, disassemble, attempt to derive the source code of the Services, or create derivative works of the Services.

3. Acceptable Use and Restrictions

You agree not to:

Use the Services in violation of any laws, regulations, or third-party rights.
Impersonate another person, misrepresent your identity, or falsely claim affiliation with any person or entity.
Use bots, scrapers, or other automated tools to access or interact with the Services without prior written consent.
Attempt to gain unauthorized access to the Services, user accounts, or any networks connected to the Services.
Interfere with or disrupt the normal operation of the Services, including introducing viruses, malware, or harmful code.
Engage in fraud, spam, harassment, or other abusive behavior.

4. Intellectual Property

All content and materials within the Services — including but not limited to software, text, graphics, logos, icons, images, videos, and audio — are protected by intellectual property laws and are the property of Gallatin Applications LLC or our licensors.

You may not:

Reproduce, modify, create derivative works from, distribute, publicly display, publicly perform, or otherwise use any content from the Services without prior written permission.
Use any trademarks, logos, or branding from the Services without our explicit consent or as permitted by applicable law.

You retain ownership of any data or content you upload, subject to the license granted to us in Section 5.

5. User-Generated Content

The Services may allow you to submit or upload content such as text, images, or other materials (“User-Generated Content”).

By submitting User-Generated Content, you:

Represent and warrant that you have the rights and permissions to do so.
Grant Gallatin Applications LLC a worldwide, non-exclusive, royalty-free license to store, display, and use your content solely for operating and improving the Services.
Agree that Gallatin Applications LLC shall not be responsible or liable for any User-Generated Content that violates any applicable laws, regulations, or third-party rights. You acknowledge that you are solely responsible for the legality, accuracy, and appropriateness of any content you submit.

We reserve the right, but not the obligation, to review, remove, or restrict access to any User-Generated Content that violates these Terms or applicable laws.

6. Privacy

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy, which is incorporated into these Terms by reference.

Certain features of the Services may rely on third-party services or integrations, which are subject to their own privacy policies and terms. Please review those policies carefully.

If you are located in a region with laws governing data collection and use — such as the European Union (GDPR) or California (CCPA) — you may have certain rights regarding your personal data under applicable law. These rights, and how you can exercise them, are described in our Privacy Policy.

7. Third-Party Services

The Services may integrate with third-party services, such as analytics tools, authentication providers, or payment processors.

You acknowledge and agree that:

These third-party services are governed by their own terms and privacy policies.
Your right to use our Services is also predicated on your compliance with any third-party services terms and privacy policies.
Applicable third parties may also impose limits on the use of or access to certain Services, in any case and without notice or liability. You agree that Gallatin Applications LLC shall not be liable for any acts or omissions of such third parties.

8. Subscriptions and Payments

Some features of the Services may require a paid subscription or one-time purchase.

Payments are processed by the App Store (Apple) or Google Play Store, and we do not directly handle billing or payment information.
By purchasing a subscription, you agree to the terms and policies of the platform where you made the purchase.

We reserve the right to change subscription pricing or features, but we will provide notice where required by law or the applicable app store.

9. Trials, Cancellations, and Refunds

Free trials, if offered, will specify their duration at the time of sign-up.
You must cancel at least 24 hours before the trial ends to avoid being charged.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle.
Refunds:
- All refunds are handled exclusively by the platform (Apple or Google), and their policies will apply.
- Gallatin Applications LLC cannot issue refunds directly.

Please consult the App Store or Google Play Store policies for detailed instructions on cancellations and refunds.

10. Updates and Changes to Services

The Services may automatically download and install updates, which may include bug fixes, new features, or changes to functionality.

You agree that:

We may deliver these updates automatically as part of your use of the Services.
We may modify, suspend, or discontinue parts of the Services at any time without notice, to the extent permitted by law.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Post the updated Terms in the Apps or on our website, and
Update the “Effective Date” at the top of this page.

By continuing to use the Services after changes take effect, you agree to the revised Terms. If you do not agree, you must stop using the Services.

12. Disclaimers and Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law:

Gallatin Applications LLC makes no warranties or representations about the Services, including any implied warranties of quality, fitness for a particular purpose, or non-infringement.
Gallatin Applications LLC does not guarantee that the Services will always be available or uninterrupted. From time to time, we may experience outages or perform scheduled or unscheduled maintenance that temporarily affects availability.
Gallatin Applications LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or other intangible losses.
Gallatin Applications LLC’s total liability to you for any claim arising from the Services shall not exceed the amount you paid to us in the last 12 months, if any.

13. Indemnification

You agree to defend, indemnify, and hold harmless Gallatin Applications LLC and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, and expenses arising from:

Your use of the Services,
Your violation of these Terms, or
Your violation of any applicable law or third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, without regard to conflict of law rules.

You agree that:

Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Yellowstone County, Montana where Gallatin Applications LLC is headquartered.
You waive any objection to jurisdiction or venue in such courts.
Any cause of action or claim you may have with respect to Gallatin Applications LLC must be commenced within one (1) year after the claim or cause of action arises.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Waiver

The failure of Gallatin Applications LLC to enforce any provision of these Terms shall not be construed as a waiver of any rights or provisions. No waiver of any term, provision, or condition of these Terms, whether by conduct or otherwise, shall be deemed a continuing waiver or a waiver of any other term, provision, or condition, unless expressly stated in writing by Gallatin Applications LLC.

17. Entire Agreement

These Terms constitute the complete and exclusive agreement between you and Gallatin Applications LLC regarding the Services and supersede all prior or contemporaneous communications, agreements, representations, and understandings, whether written or oral, related to the Services.

18. Assignment

Gallatin Applications LLC may assign its rights and obligations under these Terms without notice. You may not transfer or assign your rights under these Terms without our prior written consent.
